Collaborative Law: A Unique Approach to Family Law

Collaborative law is a relatively new approach to resolving family law issues. In collaborative law, each spouse hires an attorney. These attorneys agree that they will work only towards a settlement, and will not litigate the matter. If the divorcing spouses are unable to reach a settlement, each attorney would withdraw from the case, and each spouse would have to find a new lawyer. In collaborative law, the parties agree to conduct respectful negotiations in good faith. The overriding goal is to negotiate towards a resolution that each party finds favorable. Collaborative law looks to provide a less contentious and less adversarial process in divorce. Collaborative law may be more creative, and less destructive than divorce litigation.
