What is Collaborative Law: and What is the difference between Collaborative Law and Mediation

Collaborative Law is a way to resolve disputes in which each party hires separate attorneys whose only job is to help them settle the dispute. At the outset, everyone agrees to work together to find solutions to each persons’ issues. Further, the parties agree that they will not go to court. If the parties decide to go to court, the Collaborative Law process ends.

In mediation, there is one "neutral" party who works to assist the parties resolve their differences. The mediator is unable to give either party legal advice, and cannot help either side advocate its position.

Collaborative Law was designed to deal more effectively with all these issues, while maintaining the same commitment to resolving. Each side has attorneys. Even if one side or the other lacks negotiating skill or financial understanding, or is emotionally upset or angry, the playing field is leveled by the presence of the skilled advocates. It is the job of the attorneys to ensure that their own clients are reasonable and make sure that the collaborative law process stays productive.
